DC Personal Injury Lawyer: There Is No Such Thing as a Minor Injury

DC Personal Injury lawyers see clients who have been injured in a variety of ways.  Some of them are suffering from a car accident in DC that wasn’t their fault, while another is dealing with complications stemming from a bed bug bite.  One client may have been injured in a bike accident, while another is healing from a scooter accident.  There is no standard personal injury case, but there is one common thread in every case that is handled by DC personal injury lawyer Larry Lapidus:  the injury.

Lapidus has been representing clients in Metro DC for 4 decades.  Over the years, his desire to serve his clients has grown into a deep passion, due in part to the injustices he sees taking place when it comes to insurance claims.

Injuries are NOT Minor

Lapidus explains, “Most clients minimize their injuries.” He continues, “There is no such thing as a minor injury if pain and impairment of daily activities result from an accident.”

Here’s why:  When someone is injured in an accident, the natural human response is often, “Oh, it’s not so bad; I’ll be okay.”  While that may be a great attitude when it comes to maintaining a positive outlook, that is not how one should view their injuries for a variety of reasons.

The injured person’s health and well-being take precedence over all else.  Getting immediate medical treatment for something that may seem small at the time could mean the difference between life and death.  It also had a huge impact on the potential of securing a favorable settlement for your injuries.

When the injured does not choose to receive immediate medical treatment after the accident, the insurance adjusters who offer settlements for injuries will use the patient’s response to their own medical needs as a starting point for how to determine a settlement amount.

In other words, if the injured waits to receive treatment because of what they view as “minor” injuries, the insurance company will justify a lowball settlement with the thought of “If the injury were all that bad, they would have needed immediate medical treatment.”  This justification couldn’t be further from the truth, especially for the client suffering from injuries that – although they may be able to function day to day – are still heavily impacted by the accident that caused their injuries.

This, Personal Injury Lawyer Lapidus says, should NEVER be characterized as “minor,” and the insurance companies will surely play the “minor injury” card to determine a settlement amount.

What to Do After You’ve Been Injured

If you believe you have been injured because of someone else’s negligence, one of the best decisions you’ll make is to receive medical treatment immediately.  You can opt for an ambulance to transport you to the hospital or get to the doctor another way.  Requesting an ambulance is the ONLY sure way the police in this region will write and produce a police report.  No matter how you choose to make it happen, get to a doctor as soon as possible.

When you’ve been injured, it is not “minor” because had the accident not occurred, you would not have been hurt.  If possible, be sure to take pictures of the scene, including any signage and weather conditions.  If there were any witnesses, be sure to get their contact information, as their account of what occurred could also play a key role in your case.  Also note the time and date of the accident, as this will also serve as proper documentation for your case.
